DRAFTKINGS MAY TRANSITION ELIGIBLE CUSTOMERS FROM THE EXISTING DYNASTY REWARDS RULES & POLICY TO THIS NEW DRAFTKINGS REWARDS AND CROWN CASH RULES & POLICY ON A PHASED BASIS, AS DETERMINED BY DRAFTKINGS IN ITS SOLE AND ABSOLUTE DISCRETION, FOR ANY REASON OR NO REASON. THE PHASED TRANSITION MAY INCLUDE CUSTOMERS EARNING CROWN CASH, TIER CREDITS, ELITE REWARDS, AND ELITE REWARDS CREDITS FOR ACTIVITY ON ONE OR MORE DRAFTKINGS, GOLDEN NUGGET ONLINE CASINO, AND/OR JACKPOCKET SERVICES WHILE STILL EARNING CROWNS, TIER CREDITS, ELITE REWARDS, AND ELITE REWARDS CREDITS FOR ACTIVITY ON OTHER DRAFTKINGS, GOLDEN NUGGET ONLINE CASINO, AND/OR JACKPOCKET SERVICES. AS A RESULT, NOT ALL CUSTOMERS WILL EARN CROWN CASH, BUT WILL INSTEAD CONTINUE TO EARN CROWNS UNTIL EACH CUSTOMER HAS BEEN FULLY TRANSITIONED TO THIS DRAFTKINGS REWARDS AND CROWN CASH RULES & POLICY. FOR CLARITY, CUSTOMERS WILL NOT BE ELIGIBLE TO EARN BOTH CROWNS AND CROWN CASH FOR THE SAME ACTIVITY AND WILL NOT EARN TIER CREDITS, ELITE REWARDS, AND ELITE REWARDS CREDITS UNDER THIS POLICY AND THE DYNASTY REWARDS RULES & POLICY FOR THE SAME ACTIVITY. DRAFTKINGS WILL NOTIFY CUSTOMERS WHEN THEY HAVE BEEN TRANSITIONED TO THIS NEW DRAFTKINGS REWARDS AND CROWN CASH RULES & POLICY. UNTIL ALL CUSTOMERS HAVE BEEN FULLY TRANSITIONED TO THIS NEW DRAFTKINGS REWARDS AND CROWN CASH RULES & POLICY AND ARE NO LONGER ELIGIBLE TO EARN CROWNS, CUSTOMERS WILL REMAIN SUBJECT TO THE EXISTING DYNASTY REWARDS RULES & POLICY.

IMPORTANT LEGAL NOTICE REGARDING THIS POLICY

IMPORTANT! PLEASE CAREFULLY READ THIS DRAFTKINGS REWARDS RULES & POLICY BEFORE PARTICIPATING IN THE DRAFTKINGS REWARDS PROGRAM AND BEFORE REDEEMING OR ATTEMPTING TO REDEEM ANY CROWN CASH, AS THIS POLICY AFFECTS YOUR LEGAL RIGHTS AND OBLIGATIONS.

CUSTOMER AGREEMENT

DraftKings Inc. and/or its affiliate(s) (individually and collectively, “DraftKings”) are pleased to offer DraftKings, Jackpocket, and Golden Nugget Online Casino customers access to the Global Promotional Sourcing catalog and the opportunity to redeem Crown Cash (as defined herein) for Rewards (as defined herein) via the DraftKings Rewards Program (“Program”). Your use of and access to the Global Promotional Sourcing catalog, accruing of Crown Cash and Tier Credits (as defined herein), and the ability to redeem Crown Cash for Rewards is subject to and governed by this DraftKings Rewards and Crown Cash Rules & Policy (“Policy”), the DraftKings’ Privacy Notice (available by clicking HERE) (“Privacy Notice”), the DraftKings Daily Fantasy Sports Terms of Use applicable while you are physically located in the United States (available by clicking HERE) (“U.S. DFS Terms of Use”), the DraftKings Daily Fantasy Sports Terms of Use applicable while you are physically located in Canada (available by clicking HERE ) (“Canada DFS Terms of Use” together with the U.S. DFS Terms of Use, “DFS Terms of Use”) the DraftKings Pick6 Terms of Use applicable while you are physically located in the United States (available by clicking HERE) (“U.S. Pick6 Terms of Use”), the DraftKings Pick6 Terms of Use applicable while you are physically located in Canada (available by clicking HERE )) (“Canada Pick6 Terms of Use” together with the U.S. Pick6 Terms of Use, “Pick6 Terms of Use”), the Terms of Use of DraftKings Sportsbook for the applicable state you are physically located in while participating in the Program (available by clicking HERE) (“Sportsbook Terms of Use”), the Terms of Use of DraftKings Sportsbook and Casino for the applicable state you are physically located in while participating in the Program (available by clicking HERE) (“DK Sportsbook and Casino Terms of Use”), the Terms of Use of Golden Nugget Online Casino for the applicable state you are physically located in while participating in the Program (available by clicking HERE) (“GN Casino Terms of Use”), the DraftKings Horse Terms of Use (available by clicking HERE) (“Horse Terms of Use”), the DraftKings Racing Terms of Use (available by clicking HERE) (“Racing Terms of Use”) and the Jackpocket Terms of Service (available by clicking HERE) (“Jackpocket Terms of Service” and, together with the DFS Terms of Use, the Pick6 Terms of Use, the Sportsbook Terms of Use, the DK Sportsbook and Casino Terms of Use, the GN Casino Terms of Use, the Horse Terms of Use, the Racing Terms of Use, and the Jackpocket Terms of Service, the “Terms of Use”), each as amended from time to time and incorporated herein (this Policy, the Privacy Notice, and the Terms of Use shall collectively be referred to as the “Agreement”). DraftKings reserves the right to modify, suspend, or terminate this Policy, the Program, the provision of Crown Cash, the Tier Credits thresholds described herein, the availability of Rewards, and the amount of Crown Cash needed for any given Reward at any time and without notice, effective immediately, and it is your responsibility to review this Policy for any modifications. Your continued participation in the Program constitutes your acceptance of any modifications to this Policy.

ACCEPTANCE

You agree to the provisions of this Policy by your participation in the Program (including, without limitation, by affirmative confirmation on the DraftKings Store or elsewhere, by redeeming or attempting to redeem Crown Cash, or by accessing, engaging with, or using the Global Promotional Sourcing catalog via any DraftKings site or for any purpose related to this Program). IN THE EVENT YOU DO NOT AGREE TO BE BOUND BY THIS POLICY, DO NOT PARTICIPATE IN THE PROGRAM. In the event you wish to be excluded from the Program, you must contact support@draftkings.com and terminate your DraftKings account, Jackpocket account, and Golden Nugget Online Casino account. By participating in the Program, you acknowledge that you have read and agreed to the provisions set forth in this Policy without modification thereto. This Agreement constitutes a legal agreement between you and DraftKings and shall apply and be binding on you even after termination of your DraftKings account, Jackpocket account, and Golden Nugget Online Casino account, the termination of this Policy, or the suspension or termination of the Program.

CROWN CASH

NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU WILL NOT BE ELIGIBLE TO EARN CROWN CASH UNTIL YOU HAVE BEEN NOTIFIED BY DRAFTKINGS THAT YOU HAVE BEEN TRANSITIONED TO THIS POLICY AND HAVE ACCEPTED THE TERMS AND CONDITIONS OF THIS POLICY. AS A RESULT, NOT ALL CUSTOMERS WILL EARN CROWN CASH, BUT WILL INSTEAD CONTINUE TO EARN CROWNS UNTIL ALL CUSTOMERS HAVE BEEN FULLY TRANSITIONED TO THIS POLICY. THE PHASED TRANSITION MAY INCLUDE YOU EARNING CROWN CASH FOR ACTIVITY ON ONE OR MORE DRAFTKINGS, GOLDEN NUGGET ONLINE CASINO, AND/OR JACKPOCKET SERVICES WHILE STILL EARNING CROWNS FOR ACTIVITY ON OTHER DRAFTKINGS, GOLDEN NUGGET ONLINE CASINO, AND/OR JACKPOCKET SERVICES. FOR CLARITY, YOU WILL NOT BE ELIGIBLE TO EARN BOTH CROWNS AND CROWN CASH AT THE SAME TIME FOR THE SAME ACTIVITY. DRAFTKINGS WILL NOTIFY YOU WHEN YOU HAVE BEEN TRANSITIONED TO THIS NEW POLICY. UNTIL YOU ARE FULLY TRANSITIONED TO THIS NEW DRAFTKINGS REWARDS AND CROWN CASH RULES & POLICY AND ARE NO LONGER ELIGIBLE TO EARN CROWNS, YOU WILL REMAIN SUBJECT TO THE EXISTING DYNASTY REWARDS RULES & POLICY.

Crown Cash is a form of player loyalty points (“Crown Cash”). Individuals with an active and valid DraftKings account, Jackpocket account, or Golden Nugget Online Casino account created and maintained pursuant to the applicable Terms of Use will be automatically enrolled in the Program and eligible to earn Crown Cash, subject to any requirement for eligibility set forth herein. For more information, terms, and conditions applicable to Crown Cash, please see the How Do I Earn and Use Crown Cash? FAQ (available by clicking HERE) as amended from time to time and incorporated herein. 

Your Crown Cash balance may be revoked, expired, reduced, and/or modified by DraftKings in its sole and absolute discretion, at any time, for any reason or no reason. Once Crown Cash is earned by you and reflected in your account, Crown Cash may be redeemed through the Global Promotional Sourcing’s catalog (the “DraftKings Store”), including, but not limited to, in auctions run through the DraftKings Store and for merchandise, travel, event tickets, experiences, and/or charitable donations through the DraftKings Store; used on the DraftKings, Jackpocket, and Golden Nugget Online Casino platforms; and used on the DraftKings Shop (individually and collectively, “Reward(s)”).

To access the DraftKings Store, you may follow an associated link on the applicable DraftKings or Golden Nugget Online Casino site to the Program landing page from which you may then follow third-party links to access the DraftKings Store. The DraftKings Store, any auctions run on the DraftKings Store, and the hosting site(s) associated with the DraftKings Store are controlled and maintained by third party(ies), and DraftKings is not responsible for the DraftKings Store or any associated hosting site(s). DraftKings is not the auctioneer for any auctions on the DraftKings Store and is not responsible for such auctions. 

DraftKings reserves the right, in its sole and absolute discretion, for any reason or no reason, and without notice, to modify the amount of Crown Cash required to obtain any Reward. The redemption value of Crown Cash is determined by DraftKings and/or the applicable cost in the DraftKings Store at the time at which the Crown Cash is redeemed by you. The accumulation of Crown Cash does not entitle you to any vested rights with respect to any Rewards.

You acknowledge that Rewards may not be available and are subject to change and/or removal by DraftKings, in its sole and absolute discretion, for any reason or for no reason, with or without notice to you. You hereby waive any claim and/or rights to, and associated with, any Rewards. Furthermore, you may be subject to and/or required to accept policies or terms of use with third-party providers in order to redeem Crown Cash and/or receive Rewards. You are responsible for all taxes, fees, surcharges, incidentals, and other costs associated with Crown Cash or Rewards.

In the event you hold the status of Silver, Gold, Diamond, or Onyx, you may earn Crown Cash by completing the following actions: (i) entering into a paid DraftKings daily fantasy contest pursuant to the DFS Terms of Use, (ii) placing a paid wager that has greater than -300 odds (e.g., -200 odds or +150 odds are greater than -300 odds) or entering a pool on the DraftKings online sportsbook pursuant to the Sportsbook Terms of Use, (iii) placing a paid wager on the DraftKings online casino pursuant to the DK Sportsbook and Casino Terms of Use, (iv) placing a paid wager on the Golden Nugget Online Gaming online casino pursuant to the GN Casino Terms of Use, (v) placing a paid wager through DraftKings Horse pursuant to the Horse Terms of Use, (vi) placing a paid wager through DraftKings Racing pursuant to the Racing Terms of Use, and/or (vii) making a paid purchase of lottery ticket(s) through Jackpocket pursuant to the Jackpocket Terms of Service ((i)-(vii) each a “Crown Cash Earning Activity”). Any action using Crown Cash or other promotional bonuses, benefits, or rewards shall not be a Crown Cash Earning Activity. 

The provision, duration, value, expiration, and/or revocation of Crown Cash may be modified at any time in DraftKings’ sole and absolute discretion, for any reason or no reason. Crown Cash will be automatically credited to your Crown Cash balance. Crown Cash will accrue on a fractional basis to five (5) decimal places; however, your Crown Cash balance will only display your Crown Cash amount to two (2) decimal places (rounded down). Crown Cash accrued through your Golden Nugget Online Casino account will be reflected separately in your Golden Nugget Online Casino Crown Cash balance, while all other Crown Cash Earning Activity will be reflected in your DraftKings account Crown Cash balance. Crown Cash is not transferable between your DraftKings account and your Golden Nugget Online Casino account. 

Customers may view their Crown Cash balance at any time on the DraftKings site or on any Golden Nugget Online Casino site. 

CROWN CASH EXPIRATION

Your full Crown Cash balance accrued from all Crown Cash Earning Activity will expire in the event you do not complete a Crown Cash Earning Activity within three hundred sixty five (365) days of your last Crown Cash Earning Activity (the “Accrual Expiration Period”). In the event you complete a Crown Cash Earning Activity within the Accrual Expiration Period, the Accrual Expiration Period will restart. For clarity, use of Crown Cash or other promotional bonuses, benefits, or rewards will not restart the Accrual Expiration Period. Crown Cash issued from a promotion will expire according to that promotion’s terms.

CROWN CASH ACCRUAL RATES

All Crown Cash accrual rates are subject to change by DraftKings in its sole and absolute discretion, for any reason or no reason, at any time and without notice. The rate at which Crown Cash may be accrued varies, including, but not limited to, based on contest, wager, bet type, bet odds, or entry fee.

Crown Cash you accrue for Crown Cash Earning Activity while you are physically located in the United States will be in United States denominated Crown Cash, and Crown Cash you accrue for Crown Cash Earning Activity while you are physically located in Canada will be in Canadian denominated Crown Cash. For clarity, your physical location at the time you placed the applicable wager (as opposed to when the wager settles) or entered the applicable contest (as opposed to when the contest locks) determines whether you receive United States denominated Crown Cash or Canadian denominated Crown Cash. United States denominated Crown Cash and Canadian denominated Crown Cash will be reflected separately in your Crown Cash balance. Your Canadian denominated Crown Cash balance will be displayed while you are physically located in Canada, and your United States denominated Crown Cash balance will be displayed while you are physically located in the United States. However, you can view your Canadian denominated Crown Cash balance or United States denominated Crown Cash balance within the Transaction History of your DraftKings account by switching the currency to “Crown Cash (USD)” or “Crown Cash (CAD)” as applicable. United States denominated Crown Cash cannot be combined with Canadian denominated Crown Cash or transferred into your Canadian denominated Crown Cash balance, and vice-versa. Canadian denominated Crown Cash can only be used or redeemed while you are physically located in Canada, and United States denominated Crown Cash can only be used or redeemed while you are physically located in the United States. 

In the event you hold Bronze tier status, you will not be eligible to earn Crown Cash for Crown Cash Earning Activity. Crown Cash may accrue at the following rates in the event you hold the status of Silver tier or higher:

Sportsbook:

• You may be eligible to receive an amount of Crown Cash up to 0.24% of the amount wagered through the DraftKings online sportsbook on wagers with odds from -300 up to +1999;
• You may be eligible to receive an amount of Crown Cash up to 0.5% of the amount wagered through the DraftKings online sportsbook on wagers with odds from +2000 up to +3999;
• You may be eligible to receive an amount of Crown Cash up to 0.75% of the amount wagered through the DraftKings online sportsbook on wagers with odds from +4000 up to +6999;
• You may be eligible to receive an amount of Crown Cash up to 1% of the amount wagered through the DraftKings online sportsbook on wagers with odds from +7000 up to +10,999;
• You may be eligible to receive an amount of Crown Cash up to 1.25% of the amount wagered through the DraftKings online sportsbook on wagers with odds of +11,000 or longer; and
• You may be eligible to receive an amount of Crown Cash up to 0.09% of the entry fee for each Pool you enter on the DraftKings online sportsbook
• You may be eligible for additional Crown Cash based on the Program tier status you held at settlement of the applicable wager on the DraftKings online sportsbook. In the event you hold Gold tier status you may be entitled to receive an additional fifty percent (50%) of Crown Cash issued for settled wagers through the DraftKings online sportsbook, in the event you hold Diamond tier status you may be entitled to receive an additional 200% of Crown Cash issued for settled wagers through the DraftKings online sportsbook, and in the event you hold Onyx tier status you may be entitled to receive an additional 300% of Crown Cash issued for settled wagers through the DraftKings online sportsbook (for example only, a one hundred dollar ($100) wager through the DraftKings online sportsbook at +8,000 odds may award up to $1 in Crown Cash to Silver tier customers, $1.50 in Crown Cash to Gold Tier customer, $3 in Crown Cash to Diamond tier customers, and $4 in Crown Cash to Onyx tier customers upon settlement of the wager).

Daily Fantasy Contests:

• You may be eligible to receive an amount of Crown Cash up to 0.181% of the entry fee for a contest you enter on DraftKings daily fantasy.
• You may be eligible for additional Crown Cash based on the Program tier status you held at the time the applicable DraftKings daily fantasy contest locks. In the event you hold Gold tier status you may be entitled to receive an additional twenty five percent (25%) of Crown Cash issued for a DraftKings daily fantasy contest entry, in the event you hold Diamond tier status you may be entitled to receive an additional fifty percent (50%) of Crown Cash issued for a DraftKings daily fantasy contest entry, and in the event you hold Onyx tier status you may be entitled to receive an additional seventy five percent (75%) of Crown Cash issued for a DraftKings daily fantasy contest entry (for example only, a one hundred dollar ($100) contest entry for a DraftKings daily fantasy contest entry may award up to $0.18 in Crown Cash to Silver tier customers, up to $0.225 in Crown Cash to Gold tier customers,up to $0.27 in Crown Cash to Diamond tier customers, and up to $0.315 in Crown Cash to Onyx tier customers upon contest lock).

Casino (DraftKings casino or Golden Nugget Online casino):

• You may be eligible to receive an amount of Crown Cash up to 0.09% of the amount wagered on most slots (excluding, without limitation, Ball Drop, Digits, and Digits NOW) on the DraftKings casino or the Golden Nugget Online casino;
• You may be eligible to receive an amount of Crown Cash up to 0.018% of the amount wagered on most casino table games (excluding, without limitation, Craps, Video Poker, and Bingo Blackjack) on the DraftKings casino or Golden Nugget Online casino; and
• You may be eligible to receive an amount of Crown Cash up to 0.03% of the amount wagered on select tables games and slots on DraftKings casino or Golden Nugget Online casino; and
• You may be eligible to receive an amount of Crown Cash up to 0.01% of the amount wagered on the following games on the DraftKings casino or Golden Nugget Online casino: Craps, Poker, Video Poker, Ball Drop, Digits, Digits NOW, and Bingo Blackjack.

• Crown Cash for wagers on the DraftKings casino or Golden Nugget Online casino while you are physically located in Pennsylvania will accrue at 0.8 times the amount of Crown Cash listed above (e.g., Customers may be eligible to receive an amount of Crown Cash up to 0.072% of the amount wagered on most slots on the DraftKings casino).
• You may be eligible for additional Crown Cash based on the Program tier status you held at the time the applicable wagered. In the event you hold Diamond or Onyx tier status you may be entitled to receive an additional one hundred percent (100%) of Crown Cash issued for wagers on the DraftKings casino or Golden Nugget Online casino (for example only, a one hundred dollar ($100) wager on Craps on the DraftKings casino or Golden Nugget Online casino placed outside of Pennsylvania may award up to $0.02 in Crown Cash to Diamond and Onyx tier customers upon the wager settling).

DK Horse and DraftKings Racing:

• You may be eligible to receive an amount of Crown Cash up to 0.045% of the amount wagered through DK Horse or DraftKings Racing.
• You may be eligible for additional Crown Cash based on the Program tier status held at settlement of the applicable wager on DK Horse or DraftKings Racing. In the event you hold Gold tier status you may be entitled to receive an additional fifty percent (50%) of Crown Cash issued for settled wagers through DK Horse or DraftKings Racing, in the event you hold Diamond tier status you may be entitled to receive an additional two hundred percent (200%) of Crown Cash issued for settled wagers through DK Horse or DraftKings Racing, and in the event you hold Onyx tier status you may be entitled to receive an additional three hundred percent (300%) of Crown Cash issued for settled wagers through DK Horse or DraftKings Racing (for example only, a one hundred dollar ($100) wager on DK Horse may award up to $0.04545 in Crown Cash to Silver tier customers, up to $0.068175 in Crown Cash to Gold tier customers, up to $0.13635 in Crown Cash to Diamond tier customers, and up to $0.18180 in Crown Cash to Onyx tier customers upon settlement of the wager).

Jackpocket Lottery:

• You may be eligible to receive an amount of Crown Cash up to 0.09% of the order amount for lottery tickets ordered using Jackpocket.

Certain slots, table games, and/or video poker games may have different Crown Cash accrual rates than as set forth above. In the event you have questions related to the Crown Cash accrual rate for a particular slot, table game, and/or video poker game, contact support@DraftKings.com. DraftKings may modify, suspend, and/or terminate the amount of Crown Cash that can be accrued at any time and without notice, in its sole and absolute discretion, for any reason or no reason, including, without limitation, the amount of Crown Cash that can be accrued through a particular slot or table game or sportsbook wager type.

Crown Cash may be distributed as follows:

Sportsbook:

• Crown Cash may be distributed at the time of settlement of the associated wager. Sportsbook wagers that are cashed-out, push, voided, or otherwise canceled do not accrue Crown Cash.

Daily Fantasy Contests:

• Crown Cash may be distributed at the time that the associated contest locks (i.e., the time at which no additional contest entries will be accepted). In the event a contest is canceled after it is locked, DraftKings reserves the right to revoke Crown Cash earned therefrom in its sole and absolute discretion, for any reason or no reason.

Casino (DraftKings Casino or Golden Nugget Online Casino):

• Crown Cash may be distributed at the time the associated wager is entered on the DraftKings casino or Golden Nugget Online casino.

DK Horse and DraftKings Racing:

• Crown Cash may be distributed at the time of settlement of the associated wager.

Jackpocket Lottery:

• Crown Cash may be distributed at the time of purchase.

TIER CREDITS

FOR CLARITY, YOU WILL NOT BE ELIGIBLE TO EARN TIER CREDITS UNDER THIS POLICY AND THE DYNASTY REWARDS RULES & POLICY AT THE SAME TIME FOR THE SAME ACTIVITY.

Tier Credits are a form of player loyalty points (“Tier Credits”). Customers with an active and valid DraftKings account, Jackpocket account, and/or Golden Nugget Online Casino account created and maintained pursuant to the applicable Terms of Use will be eligible to earn Tier Credits, subject to any requirement for eligibility set forth herein. Your Tier Credits balance may be revoked, reduced, and/or modified by DraftKings at any time in DraftKings sole and absolute discretion, for any reason or no reason.

You may earn Tier Credits by completing the following actions: (i) entering into a paid DraftKings daily fantasy contest pursuant to the DFS Terms of Use, (ii) placing a paid wager that has greater than -300 (e.g., -200 odds or +150 odds are greater than -300 odds) odds or entering a pool in the DraftKings online sportsbook pursuant to the Sportsbook Terms of Use, (iii) placing a paid wager in the DraftKings online casino pursuant to the DK Sportsbook and Casino Terms of Use, (iv) placing a paid wager in the Golden Nugget Online casino pursuant to the GN Casino Terms of Use, (v) entering a paid DraftKings Pick6 contest pursuant to the DraftKings Pick6 Terms of Use, (vi) placing a paid wager through DraftKings Horse pursuant to the DK Horse Terms of Use, (vii) placing a paid wager through DraftKings Racing pursuant to the Racing Terms of Use, and/or (viii) making a paid purchase of lottery ticket(s) through Jackpocket pursuant to the Jackpocket Terms of Service  ((i)-(viii) each a “Tier Credits Earning Activity”).

The provision, duration, value, and/or revocation of Tier Credits may be modified at any time in DraftKings’ sole and absolute discretion for any reason or no reason. Tier Credits will be automatically credited to your Tier Credit balance. Your Tier Credit balance will include Tier Credits earned across your DraftKings account, Jackpocket account, and Golden Nugget Online casino account. Tier Credits will accrue on a fractional basis; however, your Tier Credit balance will only display the total Tier Credit amount as a whole number (rounded down). You may view your Tier Credit balance at any time on any DraftKings site, on any Jackpocket site (with the exception of Jackpocket Casino), or on any Golden Nugget Online Casino site. The rate at which Tier Credits are accrued varies based on contest, wager, bet type, entry fee, or purchase price. The accumulation of Tier Credits does not entitle you to any vested rights with respect to any Rewards.

TIER CREDIT ACCRUAL RATES

All Tier Credit accrual rates are subject to change by DraftKings in its sole and absolute discretion, for any reason or no reason, at any time and without notice.

Tier Credits may accrue at the following rates:

Sportsbook:

• You may be eligible to receive one (1) Tier Credit for every eighteen US dollars ($18) wagered through the DraftKings online sportsbook on wagers with odds between -300 and -126;
• You may be eligible to receive two (2) Tier Credits for every eighteen US dollars ($18) wagered through the DraftKings online sportsbook with odds between -125 and +199;
• You may be eligible to receive four (4) Tier Credits for every eighteen US dollars ($18) wagered through the DraftKings online sportsbook with odds between +200 and +499; and
• You may be entitled to receive eight (8) Tier Credits for every eighteen US dollars ($18) wagered through the DraftKings online sportsbook with odds of +500 or greater (for example only, +600 odds are greater than +500 odds).

Daily Fantasy Contests (including DraftKings Pick6):

• Customers may be eligible to receive one (1) Tier Credit for every five US dollars ($5) spent to enter a contest on DraftKings daily fantasy or DraftKings Pick6.

Casino (DraftKings Casino or Golden Nugget Online Casino):

• You may be eligible to receive one (1) Tier Credit for every ten US dollars ($10) wagered on most slots (excluding, without limitation, Ball Drop, Digits, and Digits NOW) on DraftKings casino or Golden Nugget Online casino;
• You may be eligible to receive one (1) Tier Credit for every fifty US dollars ($50) wagered on most casino table games (excluding, without limitation, Craps, Video Poker, and Bingo Blackjack) on DraftKings casino or Golden Nugget Online casino;
• You may be eligible to receive one (1) Tier Credit for every thirty US dollars ($30) wagered on select casino tables games and select slots on DraftKings casino or Golden Nugget Online casino ; and
• You may be eligible to receive one (1) Tier Credit for every ninety US dollars ($90) wagered on the following games on DraftKings casino or Golden Nugget Online casino: Craps, Poker, Video Poker, Ball Drop, Digits, Digits NOW, and Bingo Blackjack.

• Tier Credits for wagers on DraftKings casino or Golden Nugget Online casino while you are physically located in Pennsylvania will accrue at 0.8 times the number of Tier Credits listed above (e.g., you may be eligible to receive one (1) Tier Credit for every twelve dollars and fifty cents USD ($12.50) wagered on most slots on DraftKings casino).

DK Horse and DraftKings Racing:

• You may be eligible to receive one (1) Tier Credit for every twenty US dollars ($20) wagered through DK Horse or DraftKings Racing.

Jackpocket Lottery:

• You may be eligible to receive one (1) Tier Credit for every three US dollars ($3) in orders of lottery ticket using Jackpocket.

Tier Credits for spend in Canadian Dollars will accrue at 0.7 times the US Dollar rates listed above (for example only, you may be eligible to receive one (1) Tier Credit for every CAD $14.29 wagered on most slots on DraftKings casino).

Certain slot, table games, and/or video poker games may have different Tier Credit accrual rates than as set forth above. In the event you have questions related to the Tier Credits accrual rate for a particular slot, table game, and/or video poker game, contact support@DraftKings.com. DraftKings may modify, suspend, and/or terminate the number of Tier Credits that can be accrued at any time and without notice, in its sole and absolute discretion, for any reason or no reason, including, without limitation, the number of Tier Credits that can be accrued through a particular slot or table game or sportsbook wager type.

Tier Credits may be distributed as follows:

Sportsbook:

• Tier Credits may be distributed at the time of settlement of the associated wager. Sportsbook wagers that are cashed-out, push, voided, or otherwise canceled do not accrue Tier Credits.

Daily Fantasy Contests (including DraftKings Pick6):

• Tier Credits may be distributed at the time that the associated contest locks (i.e., the time at which no additional contest entries will be accepted). In the event a contest is canceled after it is locked, DraftKings reserves the right to revoke Tier Credits earned therefrom in its sole and absolute discretion for any reason or no reason.

Casino (DraftKings Casino or Golden Nugget Online Casino):

• Tier Credits may be distributed at the time the associated wager is entered on DraftKings casino or Golden Nugget Online casino.

DK Horse and DraftKings Racing:

• Tier Credits may be distributed at the time of settlement of the associated wager. DK Horse and DraftKings Racing wagers that are voided or otherwise canceled do not accrue Tier Credits.

Jackpocket Lottery:

• Tier Credits may be distributed at the time of purchase.

TIERS AND ASSOCIATED PERKS

Beginning January 3, 2026, you may be placed in a particular tier for a calendar year based upon the number of Tier Credits you earned in such calendar year. For purposes of calculating your tier status and accrued Tier Credits, (i) the calendar year begins on January 3 at 12:00:01 A.M. prevailing Pacific Time (“PT”) and ends on January 2 at 11:59:59 PM PT of the following calendar year; and (ii) Tier Credits counts and tier status reset at the end of each calendar year. DraftKings may, in its sole and absolute discretion for any reason or no reason, revoke or modify your tier status and/or withhold, revoke, or require the return of any prizes, gifts, perks, and/or Rewards awarded or given to you in connection with your tier status.

1. Some wagers are not eligible to earn Crown Cash or Tier Credits. These include: wagers made on Live Dealer and Craps; and sportsbook wagers at less than -300 odds (e.g., -2500).
2. DraftKings Store, Tier Credit Milestone Rewards, Crown Cash Multipliers, and Weekly Bonus Back are not currently available outside the United States & Canada. Free shipping on DK Shop orders is restricted to shipping addresses within the fifty (50) United States.
3. Access to VIP hosting is not available to you, and may be discontinued for you, in the event you:
   1. have a residential address outside of the United States or Canada;
   2. have not opted into receiving marketing communications from DraftKings or are ineligible to receive marketing from DraftKings;
   3. have declined VIP hosting or requested not to be contacted by DraftKings and/or a VIP host;
   4. have been identified by DraftKings with potential responsible gaming or fraud concerns, as determined by DraftKings in its sole and absolute discretion for any reason or no reason;
   5. have had your play on DraftKings limited by DraftKings, as determined by DraftKings in its sole and absolute discretion for any reason or no reason;
   6. have not placed a wager or entered a contest on DraftKings for more than ninety (90) days;
   7. have abused your VIP hosting privileges or have been abusive, threatening, or harassing to your VIP host, DraftKings, or any DraftKings employee, in each case, as determined by DraftKings in its sole and absolute discretion for any reason or no reason;
   8. are suspected of violating any terms of use of DraftKings, as determined by DraftKings in its sole and absolute discretion for any reason or no reason; and
   9. are under the age of twenty-one (21).
4. In the event you have reached your status tier due to an override and not by accruing Tier Credits, you are not eligible for Elite Rewards and Elite Rewards Gifts, including, without limitation, Norwegian Cruise Line cruises, unless you reach the tier by accruing Tier Credits.

Elite Rewards

FOR CLARITY, YOU WILL NOT BE ELIGIBLE TO EARN ELITE REWARDS, ELITE REWARDS GIFTS, OR ELITE REWARDS CREDITS UNDER THIS POLICY AND THE DYNASTY REWARDS RULES & POLICY.

In the event you are in the Diamond or Onyx tier, you may be eligible to participate in the Elite Rewards portion of the Program (“Elite Rewards”) where Customers may be eligible to select and receive additional merchandise, travel, event tickets, and experiences (“Elite Rewards Gifts”). Only customers in the Diamond and Onyx tiers are eligible to participate in Elite Rewards, however, in the event you have been gifted Diamond or Onyx tier status or status extension, you are not eligible to participate in Elite Rewards or receive Elite Rewards Gifts. To be eligible to participate in Elite Rewards, you must receive an invitation from DraftKings to participate in Elite Rewards. The offer to participate in Elite Rewards is only valid for the intended recipient. In the event you are Onyx tier and participating in Elite Rewards, your are eligible to receive Elite Gifts and Experience Credits which are a form of player loyalty points (“Elite Rewards Credits”) that can be redeemed for Elite Rewards Gift(s) from a selection of Elite Rewards Gifts determined at DraftKings sole and absolute discretion, for any reason or no reason. For clarity, only individuals in the Onyx tier who are participating in Elite Rewards are eligible to receive Elite Rewards Credits, and in the event you have been gifted Onyx tier status or status extension, you are not eligible to receive Elite Rewards Credits. Elite Rewards Credits have no monetary value whatsoever, cannot be withdrawn, and cannot be transferred. Elite Rewards Credits may be earned by earning Tier Credits and are based on your total accumulated tier credits between January 3 at 12:00:01 A.M. PT and January 2 at 11:59:59 PM PT of the following calendar year as set forth below:

For every two hundred fifty thousand (250,000) Tier Credits earned above the one million (1,000,000) Tier Credits in the table above, you are eligible to receive an additional one (1) Elite Rewards Credit. Your Elite Rewards Credits balance may be revoked, expired, reduced, and/or modified by DraftKings in its sole and absolute discretion, at any time, for any reason or no reason.

Elite Reward Gifts and/or Elite Reward Credits that are earned after January 3 at 12:00:01 A.M. PT of a calendar year must be selected and/or redeemed by January 28 at 11:59 PM ET of the following calendar year, or the Elite Reward Gifts and/or Elite Reward Credits will be forfeited.

By participating in Elite Rewards, you acknowledge that Elite Rewards Gifts may not be available, are available while supplies last, and are subject to change and/or removal from time to time by DraftKings in its sole and absolute discretion, for any reason or for no reason, with or without notice to you. By participating in Elite Rewards, you hereby waive any claim and/or rights to and associated with any Elite Rewards Gifts. Furthermore, as a condition of participating in Elite Rewards, you may be subject to and/or required to accept additional policies, assumption of risk or waivers, and/or terms of use, including, without limitation, with third-party providers, in order to redeem Elite Rewards Credits, and/or receive Elite Rewards Gifts. Elite Rewards Gift redemptions are handled by a third party and may be subject to the third-party’s own terms and conditions. Third-party partners are not under DraftKings’ control, and DraftKings will not be responsible or liable in any form for your redemption and use of Elite Rewards Gifts through the third-party partner. Elite Rewards Gifts and Elite Rewards Credits are non-cashable, non-transferable, and cannot be exchanged.

All taxes, fees, surcharges, incidentals, and other costs associated with Elite Rewards Gifts and/or the redemption of Elite Rewards Credits are your responsibility

DraftKings reserves the right to revoke your participation in Elite Rewards and/or revoke or reduce your Elite Reward Credit balance in DraftKings’ sole and absolute discretion, for any reason or no reason, including, without limitation, as a result of fraudulent activity.

LIMITATIONS ON CROWN CASH

Crown Cash has no monetary value whatsoever. Crown Cash redeemed for a Reward may only be refunded under certain circumstances, as determined by DraftKings in its sole and absolute discretion for any reason or no reason.

You shall not sell, barter, assign, bequeath, transfer (by intestate succession or otherwise), redeem for cash, give away, donate, or advertise for sale or barter of any kind, any Crown Cash, and all of your Crown Cash shall be rendered void in the event you transfer Crown Cash in any way. Crown Cash cannot be transferred by you by operation of law, such as by inheritance, in bankruptcy, or in connection with a divorce or other legal claim or proceeding. You may not pool Crown Cash or combine Crown Cash balances with others. The sale or barter, or the attempted sale or barter, of Crown Cash is prohibited. Crown Cash may not be used in conjunction with any other promotion, coupon, discount, or special offer. DraftKings reserves the right to revoke Crown Cash from you in DraftKings’ sole and absolute discretion, for any reason or no reason, including, without limitation, as a result of fraudulent activity. You are responsible for any taxes associated with your redemption and/or use of Crown Cash or associated with any Rewards.

In the event both your DraftKings and Jackpocket accounts are voluntarily or involuntarily closed or terminated, all Crown Cash associated with those accounts will be forfeited. In the event your Golden Nugget Online Casino account is voluntarily or involuntarily closed or terminated, all Crown Cash associated with that account will be forfeited.

LIMITATIONS ON TIER CREDITS

Tier Credits have no monetary value whatsoever.

You shall not sell, barter, assign, bequeath, transfer (by intestate succession or otherwise), redeem for cash, give away, donate, or advertise for sale or barter of any kind, any Tier Credits, and all of your Tier Credits shall be rendered void in the event transferred by you in any way. You may not pool Tier Credits or combine Tier Credit balances with others. The sale or barter, or the attempted sale or barter, of Tier Credits is prohibited. Tier Credits may not be used in conjunction with any other promotion, coupon, discount, or special offer.

DraftKings reserves the right to revoke your Tier Credits in DraftKings’ sole and absolute discretion for any reason or no reason, including, without limitation, as a result of fraudulent activity.

In the event your DraftKings, Golden Nugget Online Casino, and Jackpocket accounts are all voluntarily or involuntarily closed or terminated, all your Tier Credits and your tier status associated with those accounts will be forfeited.

CROWN CASH, ELITE REWARDS GIFTS, AND ELITE REWARD CREDIT REDEMPTION

Subject to the existence of, and the terms and conditions of, any agreement in place between DraftKings and third-party rewards provider(s) or third-parties that auction off Rewards, you may be eligible to redeem Crown Cash in exchange for Rewards, including those listed in the DraftKings Store, with such third-party reward provider(s), or use Crown Cash to bid on Rewards auctioned off by such third-party Reward provider(s). You are only eligible for Rewards and Elite Rewards Gifts in the event you have fully complied with all applicable terms, conditions, and rules, including, without limitation, those set forth in the Agreement. All travel, lodging, and all other costs and expenses associated with a Reward or Elite Rewards Gift, including, without limitation, incidental travel costs associated with the Reward or Elite Rewards Gift, meals, passenger tariffs or duties, airline fees, surcharges, airport fees, luggage fees, service charges or facility charges, room services, minibar, entertainment, personal charges, damage to the hotel room, security fees, gratuities, taxes, and/or other expenses, will be at your sole expense, unless expressly provided otherwise in the applicable Reward or Elite Rewards Gift description. You are solely responsible for obtaining all forms of insurance (including, without limitation, travel insurance) at your option and hereby acknowledges that DraftKings has not and will not obtain or provide any form of insurance. Details of each Reward and Elite Rewards Gift may be modified by DraftKings in its sole and absolute discretion, at any time and for any reason or no reason. 

You will be responsible for all incidental charges associated with your redeemed Rewards and Elite Rewards Gifts. You shall be responsible for providing any necessary information to DraftKings and/or any third-party Rewards or Elite Rewards Gifts provider, as necessary, and notifying DraftKings and/or such third party of any changes to such information, including, without limitation, a change of address. DraftKings is not responsible for any lost, stolen, or damaged Rewards or Elite Rewards Gift. You acknowledge that provision of Rewards and/or Elite Rewards Gifts may be delayed or made impossible for any reason, including reasons outside of DraftKings’ control. DraftKings will not be responsible for delays of Rewards and/or Elite Rewards Gift that cannot be provided due to impossibility. DraftKings will not be liable for its failure to comply with any provisions of this Policy due to reasons outside of DraftKings’ control. You acknowledge that there are factors and occurrences that may impact or affect the safety of any events, activities, or travel associated with redeemed Rewards and/or Elite Rewards Gift, including, but not limited to, SARS-CoV-2 and any variants thereof (“COVID-19”), and you assume all risk associated with such factors and occurrences, including those of serious injury, illness, death, and travel delay and associated costs.

ALL REWARDS AND ELITE REWARDS GIFTS ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE DISCLAIMER IN THE PRECEDING SENTENCE WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

All Rewards and Elite Rewards Gifts are for the exclusive use of the recipient. Rewards and Elite Rewards Gifts may not be sold, transferred, assigned, or gifted to any other person or entity. Any attempt to sell, transfer, or gift a Reward or Elite Rewards Gift, or any part of a Reward or Elite Rewards Gift, may result in disqualification and forfeiture of the Reward or Elite Rewards Gift at the sole and absolute discretion of DraftKings, for any reason or no reason. In the event you receive Rewards and/or Elite Rewards Gift you (and your guest(s) in the event applicable) may additionally be required to sign an assumption of risk or waiver in order to receive the Reward or Elite Rewards Gift.

For any Reward or Elite Rewards Gift involving attendance at an event, experience, and/or travel:

• You are responsible and liable for your acts and omissions and the acts and omissions of your guest(s) (in the event any) in connection with your and your guests’ attendance and participation in the Reward or Elite Rewards Gift.
• You must follow, and are responsible for ensuring your guest(s) (in the event any) follow, all policies, instructions, and requirements of DraftKings and any venues, hotels, or spaces associated with the Reward or Elite Rewards Gift while attending or participating in the Reward or Elite Rewards Gift, including, without limitation, health and safety protocols which may include vaccination requirements, testing requirements, wearing masks, and social distancing;
• You shall be responsible for ensuring that your guest(s) comply with all policies, instructions, and requirements of DraftKings and any hotels, spaces, and/or venues associated with the Reward or Elite Rewards Gift;
• DraftKings may prohibit you and/or your guest(s) (in the event any) from participating in or attending the Reward or Elite Rewards Gift, or any component of the Reward or Elite Rewards Gift, in the event you are unable to comply with or violate, or your guests are unable to comply with or violate, any policies, instructions, or requirements of DraftKings or any venues associated with the Reward or Elite Rewards Gift;
• You are solely responsible for determining and fulfilling any attendance eligibility requirements for your and your guests’ (in the event any) participation in or attendance at a Reward or Elite Rewards Gift, including, without limitation, any age requirements, and you acknowledge and agrees that DraftKings or any venues, hotels, or spaces associated with a Reward or Elite Rewards Gift may prohibit you or your guests’ (in the event any) participation in or attendance at a Reward, or any component of a Reward or Elite Rewards Gift, in the event you or your guest(s) (in the event any) do not meet all applicable eligibility requirements to attend the Reward or Elite Rewards Gift;
• DraftKings has the right to exclude or remove you and/or any of your guest(s) (in the event any) from participation in or attendance at a Reward or Elite Rewards Gift, or any portion of a Reward or Elite Rewards Gift, and/or deny admission to or remove you and/or your guest(s) (in the event any) from any hotels, venues, or spaces associated with a Reward or Elite Rewards Gift, as determined by DraftKings in its sole and absolute discretion, for any reason or no reason;

CONTRACTING COVID-19 CAN CAUSE INJURY, ILLNESS, DEATH, AND/OR DISABILITY, AND MAY REQUIRE OR RESULT IN THE NEED FOR MEDICAL TREATMENT AND/OR MAY RESULT IN A NEED TO QUARANTINE FOR A PERIOD OF TIME. UNDER NO CIRCUMSTANCES SHALL DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING BE LIABLE TO YOU OR YOUR GUEST(S) (IN THE EVENT ANY) FOR ANY LOSS OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY, ECONOMIC, PUNITIVE, OR CONSEQUENTIAL DAMAGES) THAT ARE DIRECTLY OR INDIRECTLY RELATED TO YOUR PARTICIPATION IN OR ATTENDANCE AT AN IN PERSON REWARD OR ELITE REWARDS GIFT, AND/OR YOUR TRAVEL TO AND FROM AN IN PERSON REWARD OR ELITE REWARDS GIFT, EVEN IN THE EVENT FORESEEABLE OR EVEN IN THE EVENT DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT (INCLUDING, WITHOUT LIMITATION, WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, OR THEFT OR DESTRUCTION). IN NO EVENT WILL DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING BE LIABLE TO YOUR OR ANYONE ELSE FOR LOSS OR INJURY, INCLUDING, WITHOUT LIMITATION, DEATH OR PERSONAL INJURY.

ONYX ROOM

Subject to the rules, terms, and conditions of this Policy, DraftKings may offer eligible casino Customers access to certain Onyx Room membership benefits. DraftKings may, in its sole and absolute discretion, for any reason or no reason, modify, suspend, or terminate the eligibility requirements required to access the Onyx Room or may restrict access to or terminate the Onyx Room at any time and without notice, effective immediately. Onyx Room provides eligible customers access to a VIP-themed casino game lobby in certain jurisdictions. The Onyx Room may also include access to higher limit games and live dealer tables with minimum and maximum bet configurations that are exclusive to Onyx Room members. In permitted jurisdictions, Onyx Room members may also be eligible to participate in exclusive progressive jackpots tied to high limit games. DraftKings may modify, suspend, or terminate the Onyx Room membership benefits available in its sole and absolute discretion, for any reason or no reason, at any time and without notice, effective immediately.

To be eligible for Onyx Room benefits, you must earn Onyx tier status. There may be a twenty four (24) to twenty eight (28) hour delay from when you achieve Onyx tier status to when you are granted Onyx Room benefits. You may also be offered access to Onyx Room membership benefits through host gift designation, as determined in DraftKings’ sole and absolute discretion, for any reason or no reason.

You are not eligible for and may immediately have your Onyx Room membership benefits revoked or access discontinued in the event you:

• are under the age of twenty-one (21) (nineteen (19) in the province of Ontario, Canada or eighteen (18) in the province of Alberta, Canada);
• have not been explicitly invited or qualified for Onyx Room membership benefits through Onyx tier status or host designation;
• have been flagged for potential responsible gaming fraud-related concerns, or potentially suspicious activity;
• your account is inactive, suspended, or under investigation;
• have abused access to DraftKings’ products or services or engaged in inappropriate behavior toward DraftKings or its personnel; or
• have not otherwise complied with the rules, terms, and conditions of this Policy.

DraftKings may revoke your access to Onyx Room membership benefits in the event you are no longer qualified for Onyx tier status or in the event the host gift designation for Onyx Room membership benefits is revoked, as determined in DraftKings’ sole and absolute discretion, for any reason or no reason. Prior to losing access to Onyx Room membership benefits, you may be entitled to complete any open and active games or rounds, but once such open or active games or rounds are completed, your access to Onyx Room membership benefits shall be revoked. In the event you are physically located in the state of Connecticut and opted into an ongoing Onyx Room exclusive progressive jackpot, you will retain access to Onyx Room membership benefits until the applicable exclusive Onyx Room jackpot concludes or you opt out of such exclusive Onyx Room jackpot.

WAIVER

BY PARTICIPATING IN THE PROGRAM, REDEEMING A REWARD OR ELITE REWARDS GIFT, USING CROWN CASH, PARTICIPATING IN ANY AUCTIONS RUN BY THIRD PARTIES USING CROWN CASH, OR PARTICIPATING IN ANY EVENTS, ACTIVITIES, OR TRAVEL ASSOCIATED WITH A REWARD, ELITE REWARDS GIFT, OR THE PROGRAM, YOU HEREBY FULLY, KNOWINGLY, AND VOLUNTARILY RELEASE DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING, FROM ANY LIABILITY ASSOCIATED WITH THE ACCUMULATION, POSSESSION, REDEMPTION, USE OR ENJOYMENT (OR ATTEMPTED ACCUMULATION, POSSESSION, REDEMPTION, USE OR ENJOYMENT) OF ANY REWARD OR ELITE REWARDS GIFT, INCLUDING ANY PROPERTY DAMAGE, EMOTIONAL DISTRESS, ILLNESS (INCLUDING COVID-19), DISEASE, PERSONAL INJURY, AND DEATH. ALL TRAVEL, LODGING, EVENT PARTICIPATION, USE, AND/OR ENJOYMENT OF REWARDS, ELITE REWARDS GIFTS, AND ASSOCIATED ACTIVITIES WILL BE PERFORMED AT YOUR SOLE RISK AND RESPONSIBILITY, AND YOU HEREBY FULLY, KNOWINGLY, AND VOLUNTARILY ASSUME THE RISK THEREOF AND RELEASE DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING, FROM ANY LIABILITY ASSOCIATED THEREWITH.

THE PROGRAM MAY CONTAIN LINKS TO THIRD-PARTY WEBSITES THAT ARE NOT OWNED OR CONTROLLED BY DRAFTKINGS. DRAFTKINGS HAS NO CONTROL OVER, AND ASSUMES NO RESPONSIBILITY FOR, THE CONTENT, PRIVACY, PRACTICES, OR YOUR USAGE OF ANY THIRD-PARTY WEBSITES, INCLUDING, BUT NOT LIMITED TO YOUR USE OF CROWN CASH IN AUCTIONS RUN BY THIRD PARTIES. IN ADDITION, DRAFTKINGS WILL NOT AND CANNOT CENSOR OR EDIT THE CONTENT OF ANY THIRD-PARTY SITE. BY PARTICIPATING IN THE PROGRAM, YOU EXPRESSLY RELIEVE DRAFTKINGS, ITS PARENTS, SUBSIDIARIES AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING FROM ANY AND ALL LIABILITY ARISING FROM YOUR USE OF ANY THIRD-PARTY WEBSITE OR YOUR PARTICIPATION IN ANY AUCTIONS RUN BY A THIRD PARTY THAT ACCEPT CROWN CASH. ACCORDINGLY, DRAFTKINGS ENCOURAGES YOU TO BE AWARE OF WHEN YOU LEAVE THE DRAFTKINGS SITE AND TO READ THE TERMS AND CONDITIONS AND PRIVACY POLICY OF EACH THIRD-PARTY WEBSITE THAT YOU VISIT.

A Customer’s eligibility for the Program, their Crown Cash balance, Tier Credits, tier status, participation in Elite Rewards, Elite Rewards Credits, and/or Onyx Room access may be revoked or modified by DraftKings at any time, in DraftKings sole and absolute discretion, for any reason or no reason, and DraftKings may, without limitation and in addition to any other rights or remedies available to DraftKings under this Policy or under applicable law, withhold, revoke, or require you to return any Rewards and/or benefits awarded or given to a Customer in connection with the Program.

INDEMNITY

BY PARTICIPATING IN THE PROGRAM, ACCEPTING ANY REWARDS OR ELITE REWARDS GIFTS IN CONNECTION WITH THE PROGRAM, PARTICIPATING IN ANY AUCTIONS USING CROWN CASH, OR USING CROWN CASH, YOU AGREE TO INDEMNIFY, PROTECT, DEFEND, AND HOLD HARMLESS DRAFTKINGS, ITS PARENTS, SUBSIDIARIES, AND AFFILIATES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, OTHER REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS OF EACH OF THE FOREGOING, FROM AND AGAINST ANY AND ALL THIRD-PARTY CLAIMS, LIABILITIES, LOSSES, DAMAGES, INJURIES, DEMANDS, ACTIONS, CAUSES OF ACTION, SUITS, PROCEEDINGS, JUDGMENTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS' FEES, COURT COSTS, AND OTHER LEGAL EXPENSES, INCLUDING, WITHOUT LIMITATION, THOSE COSTS INCURRED AT THE TRIAL AND APPELLATE LEVELS AND IN ANY BANKRUPTCY, REORGANIZATION, INSOLVENCY, OR OTHER SIMILAR PROCEEDINGS, AND ANY OTHER LEGAL EXPENSES ARISING FROM OR CONNECTED WITH YOUR PARTICIPATION IN THE PROGRAM; YOUR USE OF CROWN CASH; ANY AUCTIONS YOU PARTICIPATED IN USING CROWN CASH; ANY USE AND/OR ENJOYMENT OF REWARDS OR ELITE REWARDS GIFTS, EVENT OR ACTIVITY PARTICIPATION OR TRAVEL ASSOCIATED WITH ANY REWARDS OR ELITE REWARDS GIFT; ANY PAYMENT METHODS USED; ANY FUNDING OF YOUR DRAFTKINGS, GOLDEN NUGGET ONLINE CASINO, OR JACKPOCKET ACCOUNT; AND/OR YOUR PARTICIPATION IN ANY DAILY FANTASY (INCLUDING, WITHOUT LIMITATION, DRAFTKINGS PICK6) CONTEST, LOTTERY PURCHASE, OR ANY SPORTSBOOK, DK HORSE, AND/OR CASINO WAGER.

REPRESENTATIONS AND WARRANTIES

By participating in the Program and/or accepting any Rewards or Elite Rewards Gifts, you represent and warrant to DraftKings that: (i) you understand, agree to, and will abide by the Agreement in regard to the Program, the redemption of Crown Cash, the use of Crown Cash to bid in auctions, the redemption of Elite Rewards Credits or Elite Rewards Gifts, and the receipt of any Rewards, Elite Rewards Gifts, and/or benefits associated with the Program (ii) you will abide by all applicable laws in the jurisdiction where you are located while participating in the Program (including entering any contests and making any wagers), Rewards, or Elite Rewards Gift, (iii) you are of the age of majority as required by applicable law or regulation, (iv) you are a legal resident of the United States or Canada, and (iv) you are, while performing a Crown Cash Earning Activity, physically located in a U.S. state or Canadian province or territory in which daily fantasy contests, sports betting, iGaming, lottery courier, and/or horse wagering, as applicable, are either expressly permitted by all applicable laws and regulations or not prohibited by the same.
