IMPORTANT LEGAL NOTICE REGARDING CONTEST RULES OF DRAFTKINGS 2023 FOURTH MAJOR SPECIAL PROMOTION

The DraftKings DFS FOURTH MAJOR SPECIAL PROMOTION (“Fourth Major Special”, “TMS Promotion”, or “Promotion”) is a PGA promotion containing two unique offers for DraftKings DFS golf customers that enter featured contests throughout the Open Championship running from 7/20/2023 through 7/23/2023. In order to participate in the Promotion and be eligible to receive any of the promotional prizes awarded through the Promotion’s two (2) offers, players must opt in via their promos page prior to completing the requirements for either of the two offers. Participants who do not opt in via the promos page over the Promotional Period but after the qualifying period for an offer is completed will not be eligible to receive the designated reward for an offer. The offers available through the Promotion include:

$3M Fantasy Golf Millionaire Offer: Enter the 7/20 $3M Fantasy Golf Millionaire contest two (2) or more times to receive $10 DK Dollars.

Offer is only valid for the intended recipient who receives, views, and clicks 'Opt In' on an offer message for this offer and then submits two (2) or more entries into the 7/20 $3M Fantasy Golf Millionaire contest that locks on 07/20/2023 between Sunday, 07/16/2023 at 12:00 PM EST and Thursday, 07/20/2023 at contest lock (the "Promotional Period"). Offer expires on 07/20/2023 at contest lock. If you click 'Opt In' on an offer message and then enter the 7/20 $3M Fantasy Golf Millionaire contest two (2) or more times during the during the Promotional Period, your account will be credited with $10 DK Dollars (the “DK Dollar Reward”). Customers must opt-in to the offer from their Promos page in order to qualify for any earned DK Dollar Rewards. Contest entries submitted before receiving an offer message or opting in are not eligible. DK Dollars Rewards will be credited to eligible participants no later than 07/21/23 at 11:59 PM EST, or in the event of technical difficulties, within three business days. DK Dollars are site credits that have no cash value and are only valid for use on DraftKings. DK Dollars are used prior to any cash in your balance. DK Dollars are not withdrawable, non-transferable, and non-refundable. DK Dollars do not expire and must be played through 1x prior to withdrawal of winnings. Just like if you paid your DFS entry fee in cash, your DK Dollars entry fee is not returned to your account. There are no restrictions or play-through requirements on winnings earned from DK Dollars. Rounds 2-4 Offer: Spend $25+ in Golf Entry fees from 7/21 to 7/23 to score a $5 Drive the Green Contest Ticket.

Offer is only valid for the intended recipient who receives, views, and clicks 'Opt In' on an offer message for this offer and then submits $25+ in entry fees for GOLF contests that lock between Friday 7/21/2023 and Sunday 7/23/2023 at 11:59 PM ("GOLF Contest') (the "Promotional Period"). Offer expires on 07/23/2023 at 11:59 PM EST. If you click 'Opt In' on an offer message and then enter $25+ in GOLF Contest entry fees during the Promotional Period, your account will be credited with $5 Drive the Green Contest Ticket ( the “Ticket Reward”). The Ticket Reward will be credited to eligible participants no later than Monday, 7/24/2023 at 11:59 PM ET, or in the event of technical difficulties, within 3 business days of offer completion. Max one (1) issuances of The Ticket Reward per participant (must spend $25+ in Golf entry fees after opting in to earn the Ticket Reward). Ticket Rewards can be used on any 2023 Drive the Green Contest and will expire if unused on 12/31/23 at 11:59PM EST. Ticket Rewards have no cash value and are nontransferable.

NO RESALE: The prizes outlined hereunder may not be sold or otherwise transferred, conveyed, or assigned by the prize winner. Any attempts to transfer the prize by the prize winner shall disqualify prize winner from the prize in question.

CONDITIONS ON CLAIMING PRIZE Where legal and as applicable, the winners must consent to the use of his/her name, voice, video, and likeness/photograph in and in connection with the development, production, distribution, commercialization, promotion and/or exploitation of DraftKings and the Contest in a form reasonably directed by the organizers of the Contest or other representatives of DraftKings; Wear patches, attire, and/or promotional items as DraftKings may reasonably direct, and otherwise act as a brand ambassador for DraftKings; Refrain from acting as a brand ambassador, or in any way promoting or endorsing any third party whose core business is offering daily real-money fantasy sports contests; Agree to be bound by and adhere to all rules and codes of conduct as required by the terms and conditions during your participation in the Contest; Consent to the release of certain personal information to DraftKings for purposes related to participation and eligibility for your participation in the Contest; Execute other documents as DraftKings may reasonably request; Pay all taxes, title, registration fees, and like amounts in connection with the prizes; and At all times conduct him/herself in a professional manner, and shall not be involved in any conduct or activity that may bring the winner into disrepute, or harm the finalist or winner’s name or reputation. In the event a Prize Winner is not able to meet the Requirements for claiming the Prize, such Prize Winner, shall not be entitled to the Prize, the Grand Prize, or any other prize, compensation or monetary value whatsoever, and DraftKings will have no further obligation to the Prize Winner. By participating in this Contest or accepting the Prize, entrants further acknowledge and agree to the following Prize restrictions:

These Contest Rules are intended to be a supplement to the Terms of Use, and should not be determined to be a substitute or replacement for, or otherwise render inapplicable, the Terms of Use. To the extent the any provision of these Contest Rules conflicts with any provision in the Terms of Use, the provision contained in these Contest Rules shall apply, and the provision contained in these Contest Rules shall be deemed to supersede the conflicting provision contained in the Terms of Use unless otherwise stated herein. In no way other than a provision of these Contest Rules that explicitly conflicts with a provision in the Terms of Use shall these Contest rules to be deemed to replace or nullify any provision contained in the Terms of Use.

These Contest Rules are intended to be a supplement to the Privacy Policy, and should not be determined to be a substitute or replacement for, or otherwise render inapplicable, the Privacy Policy. To the extent the any provision of these Contest Rules conflicts with any provision in the Privacy Policy, the provision contained in these Contest Rules shall apply, and the provision contained in these Contest Rules shall be deemed to supersede the conflicting provision contained in the Privacy Policy unless otherwise stated herein. In no way other than a provision of these Contest Rules that explicitly conflicts with a provision in the Privacy Policy shall these Contest rules to be deemed to replace or nullify any provision contained in the Privacy Policy.

LIMITATION OF LIABILITY The limitation of liability contained in the Terms of Use shall be deemed to include your participation in the 2023 Fourth Major Special, and by entering the 2023 Fourth Major Special you agree to be bound, in addition to all other terms and conditions as described and contained herein and in the Terms of use, by the provisions thereof.

MARKETING DISCLAIMER By entering the 2023 Fourth Major Special, each players agrees to receive communications from DraftKings, subject to opting out when Entrant so desires. Entrant’s information will not be shared or sold to any outside party.

CONSENT OF USE Each player who enters the 2023 Fourth Major Special hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the editing, modification, replication, publication and/or other use of the names, likenesses, photographs, videos, voices, Entries and the like of the Entrant in any medium, whether now known or hereafter developed, including without limitation, any and all advertising, promotions, and other publicity conducted by DraftKings. Notwithstanding the generality of the foregoing, each Entrant further assigns any and all rights he or she may have over his or her Entry to the Sponsor without further authorization, compensation or remuneration of any kind.

MISCELLANEOUS As used herein, a "Force Majeure" event shall mean the interruption of or material interference with DraftKings' ability to grant to the winners the Prize by any cause or occurrence not within DraftKings' reasonable control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, hurricane, terrorist threat or activity, public health emergency (e.g., SARS), act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), or any federal, state or local government law, order or regulation, or order of any court. In the event of a Force Majeure, DraftKings may reschedule the Triple Threat Challenge Promotion, or may cancel the 2023 Fourth Major Special altogether. DraftKings reserves the right to alter these rules and event at any time in DraftKings' sole discretion upon reasonable notice to you; provided however that any change in the Prize shall be made prior to the beginning of the 2023 Fourth Major Special. By participating in the 2023 Fourth Major Special, the player agrees to be bound by the terms of these 2023 Fourth Major Special Rules, and the Terms of Use, and hereby agrees to disclose all applicable information to DraftKings, such information subject to the Privacy Policy.
