IMPORTANT LEGAL NOTICE REGARDING CONTEST RULES OF DRAFTKINGS, INC.
IMPORTANT! PLEASE CAREFULLY READ THESE CONTEST RULES (hereinafter, "Contest Rules") BEFORE ENTERING THE CBB MANIA BRACKET CHALLENGE AS THESE RULES AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS.
CONTEST DESCRIPTION
DraftKings is pleased to announce an exciting college basketball contest, the DraftKings College Basketball Mania Bracket Challenge exclusively for DraftKings Players. Contestants will have the opportunity to win up to $50,000 per entry.
CBB Mania Bracket Challenge is a 64 entry field where players must win a qualifier to compete. Players will be allowed up to 3 entries and will enter into head-to-head matchups against other players in a bracket style tournament. Winners of head-to-head contests will move onto the next round where they will compete in the subsequent head-to-head contest. Losers of head-to-head contests are eliminated. The field will go from 64 entries in the first round down to a single winner by end of the 6th round.
TIEBREAKERS
If one or more DraftKings Players tie in a Qualifier, in which the tie determines who wins the “ticket” to the CBB Mania Bracket Challenge, there will be a tiebreaker playoff contest between the tied DraftKings Players, to determine the Qualifier Winner. The scheduling of the tiebreaker playoff contest will be solely determined by DraftKings.
In the case of a tie in the CBB Mania Bracket Challenge, the winner will be the DraftKings Player with the higher single-player fantasy points result for each drafted player in the lineup. For example, if DraftKings Player A and DraftKings Player B tied in the daily game, and Player A's highest fantasy point scoring player was Ben Simmons with 42 fantasy points, and Player B's highest fantasy point scoring player was Brandon Ingram with 40 fantasy points, then Player A would be judged the winner. In the event that both teams have the same highest fantasy point scoring player, the same process will proceed down to the next highest fantasy point scoring player in each roster.
In the event of two identical rosters, the DraftKings Player with the most cumulative points throughout the CBB Mania Bracket Challenge will be deemed the winner. If a tie occurs in the first round, the DraftKings Player who qualified first for the CBB Mania Bracket Challenge shall be deemed the winner.
BRACKET HEAD-TO-HEAD ASSIGNMENT
Players will compete to win numbered qualifiers 1-64. The qualifier numbers 1-64 will correspond to that qualifier’s position in the bracket. “Qualifier 1” will be the first position in the top left Midwest region. “Qualifier 2” will be the first position in the bottom left West region. “Qualifier 3” will be the first position in the bottom right South region. “Qualifier 4” will be the first position in the top right East region. “Qualifier 5” will be the second position in the Midwest region playing head-to-head against “Qualifier 1”. This counterclockwise pattern will continue with every 4 qualifiers being placed in a different region. Players who win multiple entries into the CBB Bracket Challenge cannot have more than 1 entry in the same region. If a player wins multiple entries into the same region, their additional entries will be added to the next available region where they do not yet have an entry. Players can only win a maximum of 3 entries into the CBB Bracket Challenge.
Example: If a player wins “Qualifier 6”, they will be placed into the second position in the West region. If that same player wins “Qualifier 10”, then “Qualifier 10” will be placed in the third position for the South region. “Qualifier 11” will be slotted in the third position in the West region (where “Qualifier 10” would have been placed) and “Qualifier 12” will go to its originally designated location in the third position of the East region.
MAXIMUM NUMBER OF ENTRIES
Once a player has accumulated 3 entries to the CBB Mania Bracket Challenge they are no longer allowed to win entries in CBB Mania Bracket Challenge qualifier contests..
If a user with less than 3 tickets going into the day wins multiple qualifiers in the same day that puts the user over the 3 ticket limit, any tickets in excess of the 3 allotted entries would be unassigned and the user would receive an equivalent cash value instead of the excess tickets. Extra qualifiers will be added to award the unassigned ticket..
If a user already has 3 tickets going into the day, that user is not eligible to win any more tickets or cash value and the payout for the contest shall be executed as if the user was not entered.
RULES OF PLAY
Except as otherwise stated in or modified by these Contest Rules, CBB Mania Bracket Challenge shall be governed by the DraftKings Terms of Use and Privacy Policy as well as the contest rules located here: http://www.draftkings.com/help/CBB http://www.draftkings.com/help/CBB
Eligibility
Players must be 18 (19+ in Alabama and Nebraska) in years of age or older.
EFFECT OF CONTEST RULES ON TERMS OF USE
The Terms of Use on the DraftKings Website shall apply to the CBB Mania Bracket Challenge and to these Contest Rules, and are hereby incorporated herein by reference. These Contest Rules are intended to be a supplement to the Terms of Use, and should not be determined to be a substitute or replacement for, or otherwise render inapplicable, the Terms of Use. To the extent the any provision of these Contest Rules conflicts with any provision in the Terms of Use, the provision contained in these Contest Rules shall apply, and the provision contained in these Contest Rules shall be deemed to supersede the conflicting provision contained in the Terms of Use unless otherwise stated herein. In no way other than a provision of these Contest Rules that explicitly conflicts with a provision in the Terms of Use shall these Contest rules to be deemed to replace or nullify any provision contained in the Terms of Use.
EFFECT OF CONTEST RULES ON PRIVACY POLICY
The Privacy Policy on the DraftKings Website shall apply to any data collected in connection with the CBB Mania Bracket Challenge. These Contest Rules are intended to be separate from the Privacy Policy, and should not be determined to be a substitute or replacement for, or otherwise render inapplicable, the Privacy Policy. To the extent the any provision of these Contest Rules conflicts with any provision in the Privacy Policy, the provision contained in these Contest Rules shall apply, and the provision contained in these Contest Rules shall be deemed to supercede the conflicting provision contained in the Privacy Policy unless otherwise stated herein. In no way other than a provision of these Contest Rules that explicitly conflicts with a provision in the Privacy Policy shall these Contest rules to be deemed to replace or nullify any provision contained in the Privacy Policy.
LIMITATION OF LIABILITY
The limitation of liability contained in the Terms of Use shall be deemed to include your participation in the CBB Mania Bracket Challenge and by entering the CBB Mania Bracket Challenge you agree to be bound, in addition to all other terms and conditions as described and contained herein and in the Terms of Use, by the provisions thereof.
MISCELLANEOUS
As used herein, a "Force Majeure" event shall mean the interruption of or material interference with DraftKings' ability to grant to the winners the Prize by any cause or occurrence not within DraftKings' reasonable control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, hurricane, terrorist threat or activity, public health emergency (e.g., SARS), act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), or any federal, state or local government law, order or regulation, or order of any court. In the event of a Force Majeure, DraftKings may reschedule the CBB Mania Bracket Challenge, or may cancel the CBB Mania Bracket Challenge altogether.
DraftKings reserves the right to alter these rules at any time in DraftKings' sole discretion upon reasonable notice to you; provided however that any change in the Prize shall be made prior to the beginning of the CBB Mania Bracket Challenge.
For the purposes of this contest, you may be competing against a player on your blocked list, as DraftKings has disabled the block list for this contest. By entering this contest, you expressly agree that you consent to competing against any or all, as the case may be, users that you have included on your block list, and DraftKings shall have no obligation to prevent you from competing against a user on your block list in this contest.
By participating in the CBB Mania Bracket Challenge, the player agrees to be bound by the terms of these Contest Rules, and the Terms of Use, and hereby agrees to disclose all applicable information to DraftKings, such information subject to the Privacy Policy.
