IMPORTANT LEGAL NOTICE REGARDING CONTEST RULES OF DRAFTKINGS, INC.

IMPORTANT! PLEASE CAREFULLY READ THESE CONTEST RULES (hereinafter, “Contest Rules”) BEFORE ENTERING THE FANTASY MMA $100K BRACKET CHALLENGE AS THESE RULES AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS.

CONTEST DESCRIPTION

DraftKings is pleased to announce a new exciting MMA contest, the DraftKings Fantasy MMA $100K Bracket Challenge exclusively for DraftKings Players. Contestants will have the opportunity to win up to $20,000 per entry.

MMA $100K Bracket Challenge is a 32 entry field where players must win a qualifier to compete. Players will be allowed to win 1 qualifier and all qualifiers will enter into head-to-head matchups against other players in a bracket style tournament. Winners of single elimination head-to-head contests will move onto the next round where they will compete in the subsequent single elimination head-to-head contest for five rounds of the bracket (Round of 32, Round of 16, Round of 8, Round of 4, and Round of 2). The field will go from 32 entries in the first round down to a single winner by end of the 5th round. The opening bracket round of 32 will begin in 2017.

TIEBREAKERS

If one or more DraftKings Players tie in a Qualifier, in which the tie determines who wins the “ticket” to the Fantasy MMA Bracket Challenge, there will be a tiebreaker playoff contest between the tied DraftKings Players, to determine the Qualifier Winner. The scheduling of the tiebreaker playoff contest will be solely determined by DraftKings.

In the case of a tie in the Fantasy MMA $100K Bracket Challenge, the winner will be the DraftKings Player with the higher single-player fantasy points result for each drafted player in the lineup. For example, if DraftKings Player A and DraftKings Player B tied in the daily game, and Player A’s highest fantasy point scoring player was Conor McGregor with 120 fantasy points, and Player B’s highest fantasy point scoring player was Daniel Cormier with 106 fantasy points, then Player A would be judged the winner. In the event that both teams have the same highest fantasy point scoring player, the same process will proceed down to the next highest fantasy point scoring player in each roster.
In the event of two identical rosters, the DraftKings Player with the most cumulative points throughout the Fantasy MMA Bracket Challenge will be deemed the winner. If an identical tie occurs in the first round, the DraftKings Player who qualified first for the Fantasy MMA $100K Bracket Challenge shall be deemed the winner.

BRACKET HEAD-TO-HEAD ASSIGNMENT

Players will compete to win numbered qualifiers 1-32. The qualifier numbers 1-32 will correspond to that qualifier’s position in the bracket. “Qualifier 1” will be the first position in the top left region. “Qualifier 2” will be the first position in the bottom left region. “Qualifier 3” will be the first position in the bottom right region. “Qualifier 4” will be the first position in the top right region. “Qualifier 5” will be the second position in the top left region playing head-to-head against “Qualifier 1”. This counterclockwise pattern will continue with every 4 qualifiers being placed in a different region. Players can only win a maximum of 1 entry into the Fantasy MMA Bracket Challenge.

MAXIMUM NUMBER OF ENTRIES

Once a player has accumulated 1 entry to the Fantasy MMA $100K Bracket Challenge they are no longer allowed to win entries in Fantasy MMA $100K Bracket Challenge qualifier contests.

RULES OF PLAY

Except as otherwise stated in or modified by these Contest Rules, Fantasy MMA Bracket Challenge shall be governed by the DraftKings Terms of Use and Privacy Policy as well as the contest rules located here: http://www.draftkings.com/help/MMA

Eligibility

Players must be 18 (19+ in Nebraska and 21+ in Massachusetts) years of age or older

EFFECT OF CONTEST RULES ON TERMS OF USE

The Terms of Use on the DraftKings Website shall apply to the Fantasy MMA Bracket Challenge and to these Contest Rules, and are hereby incorporated herein by reference. These Contest Rules are intended to be a supplement to the Terms of Use, and should not be determined to be a substitute or replacement for, or otherwise render inapplicable, the Terms of Use. To the extent any provision of these Contest Rules conflicts with any provision in the Terms of Use, the provision contained in these Contest Rules shall apply, and the provision contained in these Contest Rules shall be deemed to supersede the conflicting provision contained in the Terms of Use unless otherwise stated herein. In no way other than a provision of these Contest Rules that explicitly conflicts with a provision in the Terms of Use shall these Contest rules to be deemed to replace or nullify any provision contained in the Terms of Use.

EFFECT OF CONTEST RULES ON PRIVACY POLICY

The Privacy Policy on the DraftKings Website shall apply to any data collected in connection with the Fantasy MMA Bracket Challenge. These Contest Rules are intended to be separate from the Privacy Policy, and should not be determined to be a substitute or replacement for, or otherwise render inapplicable, the Privacy Policy. To the extent the any provision of these Contest Rules conflicts with any provision in the Privacy Policy, the provision contained in these Contest Rules shall apply, and the provision contained in these Contest Rules shall be deemed to supercede the conflicting provision contained in the Privacy Policy unless otherwise stated herein. In no way other than a provision of these Contest Rules that explicitly conflicts with a provision in the Privacy Policy shall these Contest rules to be deemed to replace or nullify any provision contained in the Privacy Policy.

LIMITATION OF LIABILITY

The limitation of liability contained in the Terms of Use shall be deemed to include your participation in the Fantasy MMA Bracket Challenge and by entering the Fantasy MMA Bracket Challenge you agree to be bound, in addition to all other terms and conditions as described and contained herein and in the Terms of Use, by the provisions thereof.

MISCELLANEOUS

As used herein, a “Force Majeure” event shall mean the interruption of or material interference with DraftKings’ ability to grant to the winners the Prize by any cause or occurrence not within DraftKings’ reasonable control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, hurricane, terrorist threat or activity, public health emergency (e.g., SARS), act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), or any federal, state or local government law, order or regulation, or order of any court. In the event of a Force Majeure, DraftKings may reschedule the Fantasy MMA Bracket Challenge, or may cancel the Fantasy MMA Bracket Challenge altogether.

DraftKings reserves the right to alter these rules at any time in DraftKings’ sole discretion upon reasonable notice to you; provided however that any change in the Prize shall be made prior to the beginning of the Fantasy MMA Bracket Challenge.

For the purposes of this contest, you may be competing against a player on your blocked list, as DraftKings has disabled the block list for this contest. By entering this contest, you expressly agree that you consent to competing against any or all, as the case may be, users that you have included on your block list, and DraftKings shall have no obligation to prevent you from competing against a user on your block list in this contest.

By participating in the Fantasy MMA Bracket Challenge, the player agrees to be bound by the terms of these Contest Rules, and the Terms of Use, and hereby agrees to disclose all applicable information to DraftKings, such information subject to the Privacy Policy.
